Terms of ServiceEffective Date: October 28, 2025Preface: Hi! I wrote these terms of service for use in both commercial work and private agreements, and they’re written in a way that protects me when working commercially, so if it seems a bit “legal”, that’s why. As always, if you have any questions or want me to clarify why I included something, please let me know!When you commission artwork from me (Toast Dog, your artist dog), you’re agreeing to these guidelines. They cover everything from quick sketches to full illustrations, character references, and other creations we make together. To start, just send a short email or message confirming you’ve read and accept them. Without that, I can’t start. :(
Please take a moment to review – it’s all designed to keep things smooth for both of us.
As a quick highlight: You get one free revision round, clear timelines with refund protections, and personal use rights.1. Basic Principles
1.1 Welcoming Everyone
I accept commissions from all kinds of people, regardless of politics or beliefs. The door is open to everyone who wants to create something fun.
1.2 Right to Refuse
I may choose not to take a commission or end one early if it doesn’t feel right. If it happens after we’ve begun, we’ll handle refunds as in section 5.
1.3 Art I Don’t Create
I focus on positive, lighthearted work, so I avoid political or religious themes, anything hateful or offensive, illegal activities, highly controversial subjects, NSFW elements, or graphic gore. Simple, stylized or candy gore is fine if it fits the vibe.2. The Commission Process
2.1 Initial Sketch and Revisions
When describing your commission, be as specific as you can – it’s helpful to avoid ambiguity unless you specify you would like me to interpret creatively.
Once we agree and you confirm these guidelines, I’ll send an initial sketch in about 2 to 14 days, based on the idea’s complexity and our discussion.
This is your chance for feedback and one round of free revisions – share everything clearly to help us get it right and skip extra costs. We’ll check in at key milestones (like sketch delivery) to confirm progress. If something’s off-track, we can adjust timelines or discuss refunds early to keep things smooth.
I’ll incorporate your notes and complete the piece. After the final version, additional changes are free if they’re my error, $10 for minor ones, or 50% of the original price if they affect more than half the artwork.
2.2 Reference Sheets
These include unshaded full-body views for front, back, and sides. Please provide all details upfront so we start strong.
Redraws or changes to a completed side cost $20 each (no charge for my mistakes). Shaded reference sheets aren’t available right now.
2.3 Timelines and Delivery
If needed, we’ll set estimated completion dates in writing, considering the project’s scope and my current workload. Unexpected delays can occur, and I’ll update you as soon as I know.
If the artwork isn’t delivered within 120 days of the agreed start date (or a mutually extended timeline in writing), you can request a full refund minus any nonrefundable deposit. I’ll aim to complete much sooner, but this gives you peace of mind if something gets in the way.
Final files arrive digitally via email or a shared link. For physical prints, there are added fees and shipping time – we can discuss if you’d like that.3. Pricing and Payments
3.1 Payment Details
I accept CashApp or PayPal. We’ll outline the payment details at the beginning, which may include a nonrefundable deposit to get started.
3.2 Additional Fees
Flat-color backgrounds are included at no extra cost. More detailed ones with separate linework add a fee based on complexity.
Complex characters or outfits also incur fees scaled to the detail – simpler designs are covered in the base price.
3.3 Price Adjustments
I may update my rates occasionally to reflect changes in time and materials. You’ll be notified before we proceed.4. Using the Artwork and Rights
4.1 Your Permissions
You can share the artwork for personal, non-commercial purposes. Please don’t alter it without my prior approval. This helps preserve the original intent and prevents it from being used in ways that misrepresent my style, views, or involve unintended contexts, like harmful associations.
4.2 My Permissions
I can feature the artwork in my portfolio or use it to promote my services. It’s a great way for me to share the creative process. If you prefer I not share the art or use it promotionally, you have to let me know beforehand.
4.3 Editing the Artwork
Any edits require my written permission first. Please don’t remove or modify my signature or watermark. This is to ensure proper credit and avoid changes that could misrepresent my style or opinions.
4.4 No Commercial Use
The artwork is intended for personal use only. Avoid using it for profit, such as sales, merchandise, or advertising, by you or others. This protects fair value for my time and prevents it from being resold or repurposed without agreement. If commercial use interests you, let’s talk about a separate arrangement! Unauthorized use goes against these guidelines.
4.5 No AI Use
Please don’t input the artwork into AI systems for training, generation, or editing. This avoids creating substitutes that could replace future commissions and prevents alterations that might misrepresent my style, views, or opinions. Supporting original human work like this means a lot – thank you.
4.6 Your References and Ideas
When you share characters, designs, or other inspirations, just confirm they’re yours to use or that you’ve got permission – whether it’s your original creation or something from elsewhere. In exchange, you’re okay with me featuring the finished piece (including those elements) in my portfolio or promotions as in 4.2, with no ongoing obligations. If your references lead to any mix-ups with someone else’s rights down the line, you’ll be responsible to sort it out and cover related costs.5. Cancellations and Refunds
If you (the commissioner) need to cancel after we start, I’ll provide a prorated refund based on the work completed and any effects on my schedule—deposits are nonrefundable as they’re my starting commitment. We’ll discuss it thoughtfully in writing, and I’ll aim for a fair resolution.
If I (the artist) need to cancel for any reason, you’ll get a full refund if no substantial work has begun, or prorated based on clear benchmarks like 50% refund if you approved the sketch. My goal is to avoid this, but transparency ensures we’re both covered and decisions feel fair and predictable.6. Liability and Safeguards

6.1 My Liability Limits
To the full extent of the law, I’m not responsible for indirect damages like lost opportunities or data issues – my liability won’t exceed the commission payment.
6.2 Your Indemnification
You agree to indemnify and hold me harmless from claims, damages or expenses from artwork misuse, inaccurate references, or guideline violations, keeping things protected for both sides.
6.3 Force Majeure
We’re both excused from delays or issues due to uncontrollable events, such as natural disasters, personal emergencies, technical glitches, unexpected visitors from afar, pet-related mishaps with my tools, hazardous material incidents, health crises, acts of unrest, official interventions, unexpected distractions, public disturbances. Refunds aren’t guaranteed if this happens because I want the opportunity to complete the commission if I can, but I’ll most likely provide one if it seems right or I’m unable to complete the commission.7. Governing Law and Disputes

7.1 Governing Law
These guidelines follow California law, without regard to conflict principles.
7.2 Dispute Resolution
We’ll first try resolving any issues through friendly, private discussions with good intentions. If needed, we’ll proceed to binding arbitration in Sacramento under American Arbitration Association rules. If that’s not possible, California courts will handle it. The prevailing party can recover reasonable attorney fees and costs.8. Contact Information
For questions, commission requests, or clarifications, reach out via my usual channels. I’m happy to chat.9. Handling Violations
If these guidelines are not followed, I won’t be able to accept future commissions. I’ll try to address it conversationally first to avoid formal steps as I’d much prefer we work it out amicably.10. Complete Agreement and Changes
These guidelines form our full understanding and override any previous discussions. Any changes must be in writing and agreed upon by both of us.11. California Freelance Worker Protection Act (Effective January 1, 2025)
(This applies only to business or organizational clients, not personal commissions for you, your family, or household use.)
For services valued at $250 or more (whether single or aggregated over the prior 120 days), if I reside or perform work in California, please provide a signed written contract including: names and mailing addresses of both parties; a description of services, total value, rate, and compensation method; the payment due date (or how it’s determined); and the deadline for my list of completed services. Retain a copy for at least four years. This section serves as my request for that contract copy to promote transparency. All other provisions, including disputes (7.2), usage (4), and liability (6), remain in effect.
